If the deceased person was not married, then the deceased adult children can file on behalf of their deceased parent. If the surviving children are minors, a guardian or a court-appointed representative can file the claim on behalf of the minor children. In the event the deceased did not have a spouse or children, the parents of the deceased may have the right to file a wrongful death lawsuit.
