Memphis Lawyers Helping Brain Trauma Victims

Penetrating head injuries are a type of traumatic brain injury that may result in death. Tens of billions of dollars are spent on treatment and management of people who suffer traumatic brain injuries. Gunshot wounds cause a significant percentage of traumatic brain injuries, but penetrating head injuries may be caused by many different factors, including machine malfunctions, car accidents, and truck crashes. They occur whenever a projectile or another solid object breaches the cranium. If you suffer a penetrating head injury in Tennessee or a nearby state due to someone else’s negligence, you may be able to recover damages. The Memphis brain injury lawyers at Nahon, Saharovich & Trotz may be able to help you file a lawsuit.

Penetrating Head Injuries Cause Devastating Harm

Penetrating head injuries may be serious, and the type of harm may vary depending on which part of the brain is penetrated and damaged. When they are serious, they may cause a long-term disability or be immediately fatal. Quite often, they are caused by physical assault, but they may also be results of motor vehicle collisions, falls, or other accidents. Whether you may recover compensation for a penetrating head injury caused to you or someone else depends largely on the contributing causes of the accident.

If a penetrating head injury is a result of a motor vehicle accident in which someone else was negligent, it is very likely that you can recover damages. To establish the other party’s negligence, you will need to show that it is more likely than not that they drove unsafely and caused your penetrating head injury and the costs associated with it. Often, insurers and defense attorneys for an at-fault party in a motor vehicle accident will search for a way in which you may have been partially or fully to blame. Different states follow different rules regarding comparative negligence. Generally, your damages are reduced by your percentage of fault, and in some states, you may be barred from recovering at all for certain percentages of fault. This is why it is crucial not to speak to a representative for the at-fault party before retaining your own attorney.

In some cases, a penetrating head injury is a result of intentional misconduct, such as assault and battery. Although it is rare for a criminal to have the funds necessary to cover the exorbitant costs of a head injury, in some cases, another party’s negligence may have allowed the assailant to have an opportunity to attack you. For example, an apartment complex that fails to take appropriate security measures, despite a history of violent crime at the location, may be held liable in a negligent security lawsuit. Similarly, if you are injured in a mall shooting, for example, you may have a basis to hold the mall responsible if you can show that your penetrating head injury was foreseeable based on past violent crimes in or around the mall.

You may also be able to recover compensation for a penetrating head injury if it was a result of a fall on someone else’s property. In many cases, you can establish a premises liability lawsuit if you were an invitee onto a piece of property and were injured by a dangerous property condition of which the property owner knew or should have known. For example, if you suffer a penetrating head injury as a result of a fall off a hotel balcony with a broken rail, you will need to show that the owner knew or should have known about the broken rail.
