A Mississippi personal injury lawyer helps clients dealing with the aftermath of an accident. These clients have suffered injuries due to someone else’s negligent or intentional acts, and they are seeking out compensation for injury-related damages.

Each year, more than 3 million people in the United States are hospitalized due to injuries, according to the U.S. Centers for Disease Control and Prevention (CDC). In addition, the CDC notes that Mississippi has a death rate of 82 per 100,000 people from intentional and unintentional injuries. Comparatively, the national death rate from injuries totals 62 per 100,000 people.

A Mississippi personal injury attorney cannot stop accidents or prevent injuries or deaths from occurring. Rather, the attorney works on behalf of their client to get compensation from an at-fault party. Compensation won’t change the fact that the accident occurred and caused associated damages. Instead, the compensation accounts for any monetary losses the victim experienced as a result of their accident.

Nahon, Saharovich & Trotz is a Mississippi personal injury law firm unlike any other. Our personal injury attorneys are nationally recognized for their expertise. We offer outstanding legal services and support for our personal injury clients. We are easily accessible via phone or email and have convenient office locations in Jackson and Tupelo.

If you are considering filing a personal injury claim or are in the midst of a personal injury dispute, we can help evaluate your case and plan accordingly.

Types of personal injury cases we handle at NST law

We can review any personal injury legal claim that comes our way. To date, our team has handled a variety of personal injury cases. Our practice areas include:

Car Accidents

The Insurance Institute for Highway Safety (IIHS) reported 581 fatal motor vehicle crashes in Mississippi in 2019, resulting in 643 fatalities.

Mississippi car accidents occur for many reasons. Sometimes, a distracted or intoxicated driver gets behind the wheel and causes an accident that injures pedestrians or other motorists. Also, a tired driver may lose focus on the road, thereby increasing susceptibility to a crash and potential injuries. There is also the risk that a driver speeds or ignores other laws, making them more likely to cause an accident and associated injuries.

At NST Law, we want car accident victims to receive fair compensation. If someone is injured in a car accident and comes to us for help, we first learn as much as possible about the incident and conduct a complete investigation. Next, we help the individual determine who is at fault in their accident. If the accident occurred due to another driver's negligence or carelessness, we help the victim pursue the maximum compensation amount.

Truck Accidents

Large trucks were involved in 9.2% of fatal Mississippi motor vehicle crashes in 2019, as reported by the National Highway Traffic Safety Administration (NHTSA). In total, large trucks were linked to 78 fatal motor vehicle crashes during that year.

Truck drivers are responsible for getting cargo from point A to point B. They may be inclined to drive long hours or speed in hopes of reaching their final destination on schedule. Regardless, there is no excuse for unsafe truck driving. If a truck driver neglects proper safety caution, this individual can endanger others. If a truck driver is unwilling to follow proper safety protocols, this individual should be held responsible.

The Mississippi personal injury lawyers at NST Law want truck accident victims to feel confident with their case. We understand the challenges associated with determining liability in truck accident cases and have the resources to consult with the necessary experts. Fortunately, our team has over three decades of experience with truck accident cases and other personal injury litigation. Thus, we can help you get compensation if you suffered injuries during a truck accident.

Motorcycle Accidents

Mississippi is home to Natchez Trace Parkway and dozens of other scenic roads that motorcyclists enjoy year-round. But Mississippi has a higher rate of motorcycle fatalities (14.57 fatalities per 10,000 motorcyclists) than any other state according to data compiled by the NHTSA and Federal Highway Administration.

A Mississippi motorcyclist must navigate the state's roads with precision and care at all times. Failure to do so can lead to an accident that injures the motorcyclist and others.

The NST Law team can provide legal aid to those who experience injuries due to a motorcycle accident. You should not be held responsible for your accident injuries if they occurred due to another motorcyclist's failure to comply with safe driving rules. Our personal injury attorneys can work with a client and do an investigation to get details about their accident. Then, we can help our client win their motorcycle accident personal injury claim.

Wrongful Death

Mississippi law classifies wrongful death as loss of life that occurs due to the legal fault of someone else. Wrongful death can occur for many reasons, including:

  • Car accident or other accidents that occur due to someone's negligence
  • Medical malpractice
  • Use of a defective product
  • Crime or other intentional acts
  • Negligent security
A wrongful death victim's family members can file a lawsuit against an at-fault party, whether an individual or business. In this scenario, family members can claim that the victim's death occurred due to this party's negligence and that the death may have been prevented if the party took reasonable steps to protect the victim. Alternatively, family members can also indicate that the party intentionally caused the victim's death.

NST Law's Mississippi personal injury attorneys cannot change the past. Following a wrongful death, we want to work with a victim's family to ensure that they are fully supported. Our team is available to discuss a wrongful death claim. We will do everything in our power to help a victim's family get compensation from anyone responsible for a wrongful death.

Proving Liability in a Mississippi Personal Injury Case

Our attorneys strive to prove liability in Mississippi personal injury cases. To do so, we must prove the following elements of negligence:

  • The defendant owed a duty to the plaintiff.
  • The defendant breached their duty.
  • The defendant’s breach of duty (actions or inactions) caused the plaintiff’s injury, and the defendant reasonably knew their behaviors could harm others.
  • The plaintiff experienced verifiable damages (this individual must be able to show proof of their injury and resulting harm).

Each of the aforementioned elements of negligence must be present in a Mississippi personal injury case. Our team can review a personal injury claim to determine if these elements are present and how to move forward with the case.

What if I share fault for an accident or injury in Mississippi?

Miss. Code Ann. § 11-7-15 defines pure comparative negligence in Mississippi. It indicates that a plaintiff can recover damages from a defendant in a personal injury case regardless of how much the plaintiff was responsible for their injury. However, a plaintiff’s damages can be reduced based on the percentage of fault a judge or jury assigns to them.

For instance, a personal injury accident victim may pursue $10,000 from an at-fault party. If the judge determines the plaintiff was 20% responsible for the accident, this individual’s compensation will be reduced accordingly, allowing them to recover $8,000.

Miss. Code Ann. § 85-5-7 describes limitations in Mississippi personal injury cases that involve damages caused by two or more people. In these cases, each defendant is liable only for damages allocated individually in direct proportion to their percentage of fault. Joint and several liability can be held for individuals who knowingly pursue a common plan or tortious act.

Types of Available Damages in a Mississippi Personal Injury Case

Three types of damages are available to Mississippi personal injury case victims: economic, non-economic, and punitive.

Economic damages involve compensation for verifiable monetary losses. Non-economic damages are subjective compensation and relate to non-monetary losses such as pain and suffering. Punitive damages are awarded to deter illegal behaviors.

Does Mississippi law limit the amount of damages I can receive?

In general, Mississippi has no caps on economic damages in personal injury cases. However, the State has caps on certain personal injury damages.

There is a $1 million cap on non-economic damages and a $500,000 cap on medical malpractice damages in Mississippi, according to Miss. Code Ann. § 11-1-60. Also, punitive damages are capped based on the defendant’s net worth.

Deadlines to File a Mississippi Personal Injury Lawsuit

A personal injury legal claim must be submitted within three years of the accident in accordance with Miss. Code Ann. § 15-1-49. The three-year statute of limitations also applies to fraud and product liability cases.

For medical malpractice lawsuits, there is a two-year statute of limitations based on Miss. Code. Ann. § 15-1-36.

Claims Against Mississippi Municipalities

Miss. Code Ann. § 11-46-11 applies to claims against Mississippi municipalities. The statute indicates an individual can file a personal injury lawsuit against a Mississippi municipality within one year of the accident date. This lawsuit must be filed with the state’s attorney general, board of supervisors, or a municipality representative. Also, a 90-day notice of claim must be sent to the chief executive officer of the governmental entity.
