Do I Have a Car Accident Case if I Do Not Have Insurance?

If you were at fault for causing the collision, then you likely do not have a viable case. A viable case, a viable cause of action, but if you were not, if the person that hit you was at fault for the collision, then you can pursue a claim against them. Even if they don’t have insurance, you can pursue a claim against their personal assets. Typically, that’s not what we would do. We wouldn’t pursue a claim against anybody’s personal assets unless they had assets sufficient enough to satisfy a judgment, which most people do not. But we do research into that, especially when there are instances with grave injuries and no insurance. We do look to see if the person who caused the collision had, well, has any assets that we might be able to go after in order to get a judgment.
