What Compensation Can You Expect From a Personal Injury Claim?
You can pursue a few different types of compensation for a personal injury claim—economic, non-economic, and punitive damages.
Economic Damages
Economic damages compensate plaintiffs for financial costs incurred from their accident, including medical bills, lost wages, rehabilitation costs, and property damage.
Non-Economic Damages
Non-economic damages compensate plaintiffs for suffered losses and trauma that don’t carry a set financial value. Non-economic damages include pain and suffering, emotional distress, loss of enjoyment of life, and similar non-monetary losses.
Punitive Damages
Punitive damages are rare and solely awarded at a judge’s discretion. These are designed to punish the defendant and deter future misconduct. Punitive damages are only awarded when the court finds clear and convincing evidence that the defendant acted maliciously, intentionally, fraudulently, or recklessly.
Navigating Tennessee Personal Injury Laws
Certain laws applying to personal injury claims may impact your settlement and whether you are eligible to file a claim. They include the statute of limitations, comparative fault laws, and damage caps.
Statute of Limitations
Most personal injury cases in Tennessee have a short statute of limitations of just one year. The clock starts on the date the injury occurred unless the discovery rule applies. Under Tennessee’s discovery rule, the clock starts on the date the illness is or should reasonably have been discovered. This is particularly important in cases involving E. coli exposure, where symptoms may not appear immediately, and the source of contamination might take time to identify.
A year may sound like plenty of time to file suit, but it’s easier than you’d think to miss a filing deadline. Contact a lawyer promptly after an accident to avoid missing your chance to sue.
Comparative Fault
Under Tennessee’s modified comparative negligence statute, you cannot recover any damages if you were 50 percent or more at fault for the accident.
You can recover damages if you were less than 50 percent responsible for the accident, but your damages award will be decreased in proportion to your share of the fault. For example, if you are deemed 30 percent responsible for your accident, you would only receive 70 percent of the total damages.
Damage Caps
There are caps on the amount of compensation you can receive for a personal injury claim in Tennessee.
In a civil claim, you can recover as much as you lost in economic damages, regardless of the amount. However, the non-economic damages you can receive are capped at $750,000. For a catastrophic injury, this amount may be increased to $1 million due to the extensive trauma you experienced.
Punitive damages are also capped in Tennessee. The amount you can receive in punitive damages is either two times the amount you were awarded in economic damages or $500,000, whichever is greater.
