In Tennessee, the first person with priority to file a wrongful death claim is the surviving spouse of the decedent. If there is no surviving spouse, the next in line is the surviving children or next of kin. After that, if there are no children or next of kin, the decedent’s estate’s personal representative may file a claim, and after that the decedent’s surviving parents may file a claim if the decedent was a dependent. Finally, an administrator of the estate may file suit.

In a wrongful death lawsuit, liability is expressed in monetary damages. There may also be a criminal case pending against the defendant in a fatal car accident case. However, the standard of proof in a criminal case (“beyond a reasonable doubt”) is significantly higher than it is in a civil personal injury lawsuit (“preponderance of the evidence”). Even if the defendant is acquitted, or the charges are dismissed in a criminal case, you may have grounds to file a wrongful death lawsuit.
