  1. The defendant must have violated a statute or ordinance that imposes a duty or prohibition for the benefit of a person or the public;
  2. The injured party must be within the class of persons intended to benefit from or be afforded protection by the statute or ordinance; and
  3. The injured party must show that the negligence was the proximate cause of his or her injuries.

Generally, when a truck driver drives in excess of the posted speed limit and that leads to a motor vehicle crash with injuries, then the injured party may be able to seek compensation for medical expenses, pain and suffering, property damage, and lost income from the truck driver and/or the trucking company under the doctrine of negligence per se.
