According to the Tennessee Jury Verdict Reporter, Nahon Saharovich and Trotz obtained two of the largest auto negligence verdicts for the year 2015 . According to the Jury Verdict Reporter, there were only 6  jury trials in excess of $100,000 and the law firm of  Nahon, Saharovich and Trotz obtained two of those verdicts.

Here is the brief summary of each case as reported by the Jury Verdict reporter:

1. Derek Fairchilds, an attorney with NST represented a plaintiff who was 14 years old who was involved in an accident and as a result suffered permanent brain injury. A Henderson jury awarded $1,019,652.

2. David Siegel and Jason Yasinsky, attorneys with NST represented an intoxicated pedestrian who was walking along a dark road at night and was struck by a passing motorist and sustained serious injuries. A Madison county jury awarded $205,043.

Auto Accident

Auto Accident Caused by Construction Company

Our firm represented a young man who was severely injured in an automobile accident caused by a construction company who negligently failed to place proper traffic signs at an intersection. As a result, our client’s vehicle violently collided with another vehicle, and our client sustained traumatic and permanent brain injuries. Couple Injured in Catastrophic Car Wreck

The law firm represented an elderly couple married for over sixty years. They were involved in a catastrophic car wreck. The husband had debilitating injuries, including brain trauma that resulted in his death. Bus Passenger Injured in Collision with Commercial Truck

Our firm represented a middle-aged woman who was severely injured in a motor vehicle collision while traveling as a passenger on a bus that rear-ended a commercial truck. As a result of this wreck, our client sustained permanent disabling injuries to her legs, hips and arms. Passenger Injured by Drunk Driver

The firm represented a twenty-year-old girl who was a passenger in an automobile driven by an individual who was charged with driving under the influence of alcohol. The defendants maintained that our client was particularly negligent due to her being in an automobile with an individual who had been drinking. The firm represented a twenty-seven year old female who was involved in an accident in which a defendant ran a red light and struck our client’s automobile. Our client was hospitalized for four days for a fracture to her right humerus which required surgery. Our client received an impairment rating of 5% to the upper extremity and as a result of the injury she was not able to work for over one month. Infant Death Resulting from Car Wreck

Our firm represented a twenty-one-year-old woman who was in a head-on automobile collision where she suffered blunt abdominal trauma. At the time of the wreck, she was seven months pregnant. Although her baby was monitored closely through the remaining pregnancy, he was born at 38 weeks with severe neurological deficits and died after 18 days. Our investigation revealed that a brain injury had occurred as a result of the automobile wreck nearly two months before his birth. Our firm enlisted a team of experts and began to develop the case for the wrongful death of the baby. The team of expert obstetricians, neonatologists, and pediatric neurologists all determined that the cause of the baby’s neurological outcome and death was the automobile collision. Auto Accident While On the Job

Our law firm represented a fifty-one-year-old female who was struck on the interstate by an individual who was within the course and scope of his employment and driving a company vehicle. Our client was admitted to the hospital and she was diagnosed with fractured bones in her left hip and leg, two fractured ribs on her left side and hematomas in her pelvic area. In addition, she sustained back injuries and knee injuries. As a result of the accident, our client underwent several surgeries including an operation to repair her hip, surgery to fix the fracture on her leg, a total knee replacement and a total hip replacement. Since our client was working for her employer at the time of the accident and the client had received workers’ compensation benefits, the firm was able to significantly reduce the amount of money our client had to repay the workers’ compensation carrier and her medical providers, thereby resulting in an even greater financial recovery for our client.

61-Year-Old Woman Suffers Catastrophic Injuries

Our firm represented a sixty one year old woman who suffered catastrophic injuries in an automobile wreck caused by an industrial forklift. As a result of this violent collision, our client sustained a traumatic brain injury and debilitating permanent and life changing abdominal injuries. These complex injuries required a sophisticated team of experts chosen for their experience in treating traumatic brain injuries and abdominal injuries. Our client had previous medical treatment for an abdominal disease and we had to determine whether the pre-existing injuries were aggravated due to the wreck. Our firm located and retained a noted gastroenterologist who served as an expert witness in proving that the pre-existing abdominal injuries were aggravated in the wreck. Pedestrian Struck by Negligent Vehicle

Our client, a seventy-six-year-old woman, was exiting a Kroger store with her groceries when she was struck by a driver traveling too fast and not keeping a proper lookout in the Kroger parking lot. The impact broke our client’s leg requiring orthopedic surgery where rods and plates had to be inserted due to the severe fracture. The defendant driver claimed that our client simply fell in the parking lot and that there was no impact with the car. The NST team of lawyers worked quickly to locate and preserve evidence of how the wreck occurred and discovered that Kroger had store video that captured the impact between our client and the defendant. Car Accident Causing Connective Tissue Injury to Back and Neck

Our client was involved in a car wreck where she sustained connective tissue injuries to her back and neck. The insurance company denied that our client was injured and alleged that she was faking and exaggerating her injuries. The NST team of lawyers hired experts to demonstrate to the jury that our client was injured in the accident and lost income due to her injuries. Before the trial, the insurance company made an offer that client and NST agreed was unreasonable and NST took the case to trial. Trucking Accident

Serious Eighteen Wheeler Truck Accident

Our firm represented a family that was struck by an eighteen wheeler. Our clients were sitting at a red light when an eighteen wheeler failed to stop and plowed into the back of our client’s vehicle. Tragically, the husband died due to his injuries and the wife suffered catastrophic injuries. NST settled with the trucking company for a confidential seven figure settlement due to the death of the husband and injuries to the wife.

Vehicle Rear Ended by 18 Wheeler

The firm represented a sixty-seven-year-old male who was rear ended on the interstate by an 18-wheeler truck. The client had sustained serious injuries including a fractured neck, fractured vertebrae and rib fractures. The testimony of a witness was that the client was traveling at an extremely low rate of speed prior to being struck by the defendant truck driver. Head On Collision Caused by Tractor Trailer

The firm successfully represented a forty-three-year-old disabled veteran who was involved in an automobile accident in which the car he was driving was struck head-on by a tractor trailer truck that turned in front of him. Following the accident, the client was taken by air ambulance to a hospital where he was found to have suffered multiple left leg and hip fractures which led to serious blood clotting problems. These injuries required extensive medical treatment and recovery. The firm aggressively pursued litigation and documentary discovery from the trucking company and was able to successfully mediate the case and obtain a settlement of $685,000.00 for the client. The firm was also able to secure significant reductions in the medical bills resulting in more money for the client.

Truck Driver Struck by Industrial Forklift

Our client was a truck driver delivering to a warehouse when he was struck by an industrial forklift inside the warehouse breaking the bones in his leg. The defendants denied fault for the incident claiming that our client should not have been in the area the accident took place. Our client required surgery for the broken bones in his leg. NST hired and used seven expert witnesses including a Forklift expert, vocational expert, economist, orthopedic expert and psychologist to show that the defendant company did not follow the established rules for operating forklifts and was at fault. These experts were also used to show the human damages our client suffered due to the fault of the defendant company for not following the rules. NST also hired a focus group expert to conduct several focus groups to help us prepare for trial. NST aggressively prepared the client’s case for trial and the defendant company settled the case a few days before the start of trial for the sum of $645,000.00.

Truck Driver Struck by Another Commercial Motor Vehicle

Our client was working as a commercial motor vehicle operator on the job when he was struck by another eighteen wheeler. The defendant truck driver was not paying attention and going too fast and ran into the back of our client’s trailer. When this wreck happened, our client had just recovered from a previous back surgery involving an unrelated wreck. The trucking company defendant attempted to reduce our client’s damages arguing that the client’s current back problems were due to the unrelated wreck and not the wreck that they caused. The trucking company even hired two expert witness doctors to testify that our client’s back was not injured in the wreck. The NST team of lawyers deeply believed in our client and his injuries and hired four expert witness doctors to show that in fact our client did suffer back injuries from being struck by the eighteen wheeler. In addition, NST hired two employment expert witnesses to show that our client had suffered a loss of income due to his back injuries. The case settled at a judicial mediation for the sum of $500,000.00. NST was also able to negotiate an agreement with the workers’ compensation insurance carrier where the insurance company agreed to waive the sum of $341,039.55 that our client had received in a prior workers’ compensation settlement due to the wreck.

Trucking Accident Resulting in Death

Our firm represented a 58-year-old man who was tragically killed when he was struck by an 18-wheeler on a bridge. Team NST immediately began its investigation and development of this case for hotly contested litigation. The Trucking company refused to accept responsibility for this wreck, so our litigation team enlisted several experts, including accident reconstructionists, trucking industry experts and engineers. Product Liability

Fatality Due to Faulty Tire

Our firm represented the family of a fifty-two-year-old individual who had been killed when a construction vehicle he was operating went out of control and crashed. The vehicle caught fire, trapping him inside, unable to be rescued. After another law firm had previously declined the case, our firm was hired and began to investigate. We determined that a tire on the construction vehicle was defective, and filed suit against the manufacturer, who was located overseas. Our firm and co-counsel hired experts and began to develop the case. The investigating experts found that the tire on our client’s vehicle was so poorly made that not only was it unfit for a large and heavy commercial vehicle of the size our client was operating at the time of his death, its rubber would have been too thin for a passenger vehicle to drive on safely. After protracted litigation and many depositions, including those of the children that were left behind by the fire and death, the case was resolved at mediation for a significant confidential amount.

Traumatic Injuries From Airbag Malfunction

Our firm represented a thirty-year-old individual who was driving his 2001 Honda Civic when another vehicle pulled out in front of him, causing his airbag to deploy. Shards of metal were blasted through the airbag’s fabric, and it was melted in some spots. Metal from the airbag struck his right eye and caused him to become permanently blind in that eye, and the airbag’s excessive deployment caused facial fractures and a traumatic brain injury. About six months after the wreck, our client received an “Important Safety Recall Notice” warning that his 2001 Honda’s airbag may contain metal fragments which could pass through the airbag, causing serious injury. We had the vehicle evaluated by experts who found evidence that the 2001 Honda Civic’s airbag contained metal fragments which were propelled through the fabric during the crash. The experts also opined that the Honda’s airbag’s deployment was “explosive” in nature and dangerously excessive. Our firm along with co-counsel, using experts and documents, were able to prove that Honda and the airbag manufacturer had known of the airbag’s potential dangers for years before issuing the recall notice. We had the client evaluated by neurological experts, a neurosurgeon and obtained opinions from economic experts, in development of his claim. His case was ultimately settled at mediation for a significant confidential amount.

44-Year-Old Who Took the Pain Control Medication Celebrex Suffers Heart Attack

Our firm represented a 44 year old who took the pain control pill, Celebrex. As a result of taking this medication, our client had a heart attack and, unfortunately, passed away shortly after sustaining this heart attack. Our firm represented this client and was able to show that this medication was linked to an increased risk of heart attacks and stroke associated with long term and high dosage use of this medication. 47-Year-Old Who Took the Pain Control Medication Vioxx Suffers Heart Attack and Dies

Our firm represented a 47 year old who took the pain control pill, Vioxx. As a result of taking this medication, our client had a heart attack and, sadly, passed away from this heart attack. Our firm represented this client and was able to show that this medication was linked to an increased risk of heart attacks and stroke associated with long term and high dosage use of this medication. Our attorneys, in a coordinated effort with firms across the nation, assisted in preparing the case for the litigation process by contacting medical experts and scientific experts to confirm the link between this medication and its increased risk of heart attacks and stroke, that the creator of the drug, Merck, was aware of this risk, and did not inform the consumers of this risk. This case was referred to multi district litigation in the Eastern District of Louisiana. Throughout the course of this complex litigation, the NST team of attorneys worked with national counsel to develop the case through many depositions of witnesses and experts. As a result of this litigation, Vioxx was withdrawn from the market in 2004. Our firm was also able to secure a settlement for the children of the deceased for $429,138.80.

27-Year-Old Who Took the Birth Control Yaz and Developed Blood Clots in Lungs

Our firm represented a 27 year old who took the birth control pill, Yaz. As a result of taking this medication, our client developed blood clots in her lungs, resulting in a lengthy hospitalization. After discharge, she had to take blood thinners and was required to be on blood thinners when she subsequently decided to have a child. Our firm represented this client and was able to show that this medication was linked to an increased risk of blood clots, which resulted in severe, disabling injuries to our client. Chain Saw Incident Causing Laceration and Nerve Injury to Arm

Our client, sustained a laceration and nerve injury his arm after being cut with a chain saw that was being operated by an individual that had never received any type of training regarding the operation of the chain saw. NST sued the company that employed the chain saw operator for breaking the rules and the defendant company denied fault. After hiring experts and preparing the case for trial, NST took the case to trial in Madison County, Tennessee. The defendant company never made an offer to settle the case. The Madison County jury agreed that the defendant company broke the rules and included in its verdict money damages for our client in the amount of $189,688.02.

Workers’ Compensation

Personal Injury at Work

Our firm represented an individual concerning a personal injury and workers’ compensation claim. Our client was working for his employer as a billboard poster, when he fell approximately 35 feet from a billboard catwalk. He sustained serious injuries, including 2 broken arms, which required surgery. We were able to get his temporary total disability payments started and upon his release from the doctor, we settled his workers’ compensation claim. We investigated his personal injury claim and hired an expert engineer who determined that the catwalk was not properly welded. We litigated this case and we were eventually able to mediate our client’s third party claim for over $950,000.00.

Workers’ Compensation Claim with Permanent Disability

Our Firm represented a forty-nine-year-old man who was involved in a wreck through no fault of his own while working on the job for his employer. The client suffered a traumatic brain injury in the wreck which his employer denied. As a result of his traumatic brain injury, the client developed psychological injuries which the employer denied as well. Our firm fought for the client and the employer was ordered to provide medical treatment for all his injuries. The employer hired a doctor to try and prove that client did not have a traumatic brain injury and was exaggerating his injuries. When the employer refused to pay a fair settlement for client’s permanent injuries and inability to work, our firm took the case to trial and presented the testimony of three experts to prove that client did in fact have a traumatic brain injury and psychological injuries. The trial court disregarded the employer’s “hired gun” expert witness and ruled in favor of the client and found him permanently and totally disabled and awarded a judgment against the employer in the amount of $561,916.90. Furthermore, the trial court ordered the employer to pay for the medical treatment for his on the job injuries for the remainder of his life.

Judgment Awarded for Inadequate Safety Regulations

The law firm successfully obtained a jury verdict in the amount of $211,000.00 against the Defendant, reduced by 10% for negligence on behalf of the Defendant’s employee and 10% on behalf of our client. We represented an individual who was injured by an employee of a company due to inadequate safety regulations. Our client was cut by a chainsaw, sustaining deep lacerations to his right arm, as well as severing tendons, which required surgery. Our client incurred medical bills in the amount of $29,775.71. Not only were we able to assist said individual with his workers’ compensation claim, our firm was also successful with the pursuit of a third party liability claim against the company who employed the negligent worker.

Medical Malpractice

Improper Medical Treatment Results in Death

The firm represented a widow on behalf of her deceased husband in a medical malpractice case. The Decedent went in for stomach pain. The medical personnel knew he had an abdominal aneurysm but failed to treat or consider the aneurysm as a cause of his stomach pain. The Decedent was discharged and was dead within 24 hours due to a ruptured aneurysm. The case was contested. The firm prepared the case for trial, engaged in extensive discovery, retained experts, obtained an economist to calculate loss of earning capacity and took the depositions of numerous medical personnel. Negligent Use of Forceps to Extract Infant During Delivery Causing Death

Our firm represented a family in a medical malpractice case who suffered the loss of their newborn son due to injuries sustained during the delivery process. During labor, the mother’s condition deteriorated creating the need for an emergency delivery. Although the mother did not give consent for the doctor to do so, the doctor used forceps to extract the infant during delivery. The use of the forceps caused the infant’s brain to be separated from the spinal cord. The baby lived only 14 days after birth. Negligent Practice of Leaving Sponge Following Surgery Causing Permanent Injuries

NST represented a 37-year-old man in a medical malpractice action following a surgery related to his diverticulitis.  During the removal of a colostomy, a sponge was left inside his abdomen following the surgery.  As a result of the complications from this sponge, he was forced to undergo further surgical intervention resulting in the loss of a large portion of his intestine.  He suffered severe permanent injuries, including short gut syndrome, a condition where the body is unable to fully absorb nutrients from food.  Our firm engaged in heated litigation with the defendants, who continually denied their liability in this matter.  We obtained a team of experts, including medical experts and vocational experts, to create a foundational support for our client’s case.  Our attorneys engaged in a lengthy litigation process, including depositions, court hearings, and witness preparation for trial.  As the trial neared, NST was able to successfully resolve the matter at mediation, obtaining a significant confidential settlement for our client.

Nursing Home Neglect

Death from Starvation and Dehydration

The law firm represented a family on behalf of their deceased brother in a nursing home abuse and neglect case. The Decedent was admitted to the nursing home because of his mental condition and various physical ailments. He was sixty-one years old at the time of his admission. The Decedent was there for two and a half weeks and was given no food or water during the last four days there. He died as a result. The case was extensively litigated and was prepared for trial when the matter was resolved for a significant out of court settlement, the amount which is confidential.

Fatality Caused by Sepsis from Bed Sore

The law firm represented a family on behalf of their deceased father in a nursing home abuse and neglect case. The Decedent was sixty years old and was admitted to the nursing home after a stroke. He was kept at the nursing home for about eight months. During that time period, the Decedent was not properly turned and was left in his urine and feces. Eventually, a bed sore formed on his buttock, which became septic and killed him. A lawsuit was filed and the firm engaged in a successful battle to preserve the family’s right to trial by jury by defeating an arbitration provision.
