Nashville Vaccine Injuries

Vaccination Injury Lawyers Serving Nashville and Davidson County

Thousands of vaccines are safely administered across the country every day. However, on occasion some people suffer adverse reactions that leave them severely injured or disabled. When vaccines do go wrong, side effects can include shoulder injuries, paralysis, allergic reactions, and neurological disorders. In 1988, the United States Congress implemented the National Vaccine Injury Compensation Program (VICP) to help those injured by adverse reactions to vaccines. If you or a loved one has suffered from a vaccine-related injury, the vaccine injury lawyers at Nahon, Saharovich & Trotz are available today to discuss and evaluate your potential claim. For over 30 years, our Nashville personal injury attorneys have been representing injured clients, and we work every day to advocate on their behalf. If you believe a vaccine caused or contributed to a medical condition or injury you or a loved one developed, compensation may be available under federal la

Can I Bring a Claim Under the VIPC?

Under the VIPC, you may bring a claim for certain injuries or conditions suffered as a result of taking a vaccine. However, the injury and condition must be significant enough to last for more than 6 months, or require hospitalization/surgery. There is also a time limitation on bringing a claim under the VICP. If you have suffered from an injury resulting from a vaccine, you have 3 years from the date of experiencing the first symptoms of the injury to file a petition with the program. If a loved one has died resulting from an adverse reaction with a vaccine, then their parent or legal guardian has 2 years from the date of death and within 4 years after the onset of the vaccine-related injury from which the death occurred. If you think you may have a viable claim, you should contact a vaccine injury lawyer in the Nashville area to make sure all statutory timelines are met.

Compensation Available Under the VICP

The VICP compensates those injured for a variety of injuries and conditions. These injuries range from paralysis to soreness of the shoulder. The Vaccine Injury Compensation Program was created to compensate injured parties for their economic damages (medical bills and lost wages) and their non-economic damages (pain and suffering). Through the program, there is no cost for hiring an attorney to assist you with your claim. Your attorney’s fees and legal costs incurred pursing your claim are covered under the program.

Which Vaccines are Covered Under the VICP?

Each year, new vaccines are tested and regulated by the U.S. Food and Drug Administration (FDA). Many of these vaccines may take years before any adverse affects are known and documented. Under the VICP, certain side effects and injuries from the following vaccines have been deemed compensable:

  1. Tetanus (DTaP, DTP, DT, Td, or TT)
  2. Pertussis (DTP, DTaP, P, DTP-Hib)
  3. Vaccines containing measles, mumps, and rubella virus or any of its components (MMR, MM, MMRV)
  4. Flu
  5. Hepatitis B
  6. Oral Polio Vaccine (OPV)
  7. Inactivated Polio Vaccine (IPV)
