Experienced Medical Device Attorneys Serving Victims of Essure

Essure is marketed to women as a permanent birth control procedure. It is manufactured and marketed by Conceptus Inc., a subsidiary of large pharmaceutical company Bayer. Lawsuits have been filed against these entities across the United States, alleging the device results in serious side effects such as abdominal pain and bleeding. To speak with an Essure lawyer regarding injuries sustained by yourself or a loved one, call Nahon, Saharovich & Trotz. Our Memphis medical device lawyers are ready to take your call today.

What is Essure?

Essure was approved by the U.S. Food & Drug Administration (FDA) in 2002. The Essure birth control procedure is offered as an alternative to tubal ligation. Essure is comprised of two coils (nickel-based) that are inserted into a woman’s fallopian tubes through a procedure that can take less than 10 minutes. Neither anesthesia nor an incision is required. Once inserted, scar tissue will begin to form around the inserts. It can take three months for tissue to form a blockage in the fallopian tubes, which prevents sperm from reaching the woman’s eggs.

Risks of Essure

Medical research has shown that Essure can cause serious side effects including, but not limited to:

  • Pelvic pain
  • Weight gain
  • Puncturing of the fallopian tubes
  • Joint pain
  • Fatigue
  • Abdominal pain
  • Bleeding
  • Headaches

In response to doctors and researchers pointing out negative side effects of Essure, the FDA has monitored the device and instituted several warning label changes. In 2011, labeling was updated to include a nickel sensitivity warning. In 2013, labeling was updated to warn patients of risks of chronic pain and device migration. In 2016, the FDA required a “black box” warning, and Bayer was instructed to conduct a study regarding risks and rates of complications involving the procedure.

Essure Lawsuits Filed Against Bayer

The FDA has received more than 5,000 formal complaints regarding Essure, and to date, Bayer has found itself as a defendant in more than 3,700 Essure lawsuits across the United States filed on behalf of women who received the Essure insert and suffered injuries as a result. To ensure all theories of recovery are explored in your case, it is recommended to speak with an Essure attorney immediately, as each state will have its own statute of limitation and statute of repose.

A typical Essure lawsuit can contain multiple causes of action. Some include general negligence, insufficient testing, and failure to warn of adverse side effects. Bayer is being accused of creating and marketing an unreasonably dangerous product, despite possessing knowledge of adverse side effects. Victims can seek monetary compensation (damages) in the form of medical bills, lost wages, pain and suffering, loss of consortium, emotional distress, and more. Each state has its own product liability standards and laws concerning elements of damages.
