Our firm represented a young man who was severely injured in an automobile accident caused by a construction company who negligently failed to place proper traffic signs at an intersection. As a result, our client's vehicle violently collided with another vehicle, and our client sustained traumatic and permanent brain injuries. We developed the case by retaining experts such as a life-care planner and a neurological psychologist to demonstrate the special needs of our client. The case was litigated and mediated with a settlement for over $2,200,000.00. Our firm represented a thirty-year-old individual who was driving his 2001 Honda Civic when another vehicle pulled out in front of him, causing his airbag to deploy. Shards of metal were blasted through the airbag’s fabric, and it was melted in some spots. Metal from the airbag struck his right eye and caused him to become permanently blind in that eye, and the airbag’s excessive deployment caused facial fractures and a traumatic brain injury. About six months after the wreck, our client received an “Important Safety Recall Notice” warning that his 2001 Honda’s airbag may contain metal fragments which could pass through the airbag, causing serious injury. We had the vehicle evaluated by experts who found evidence that the 2001 Honda Civic’s airbag contained metal fragments which were propelled through the fabric during the crash. The experts also opined that the Honda’s airbag’s deployment was “explosive” in nature and dangerously excessive. Our firm along with co-counsel, using experts and documents, we were able to prove that Honda and the airbag manufacturer had known of the airbag’s potential dangers for years before issuing the recall notice. We had the client evaluated by neurological experts, a neurosurgeon and obtained opinions from economic experts, in development of his claim. His case was ultimately settled at mediation for a significant confidential amount.
Our firm represented a sixty-one-year-old woman who suffered catastrophic injuries in an automobile wreck caused by an industrial forklift which failed to yield while pulling out of a construction site. As a result of this violent collision, our client sustained a traumatic brain injury and debilitating permanent and life changing abdominal injuries. This complex injury case required a sophisticated team of experts discovered across the regional area for their experience in treating head injuries and gastrointestinal injuries. Our firm represented the family of a fifty-two-year-old individual who had been killed when a construction vehicle he was operating went out of control and crashed. The vehicle caught fire, trapping him inside, unable to be rescued. After another law firm had previously declined the case, our firm was hired and began to investigate. We determined that a tire on the construction vehicle was defective, and filed suit against the manufacturer, who was located overseas. Our firm and co-counsel hired experts and began to develop the case. The investigating experts found that the tire on our client’s vehicle was so poorly made that not only was it unfit for a large and heavy commercial vehicle of the size our client was operating at the time of his death, its rubber would have been too thin for a passenger vehicle to drive on safely. After protracted litigation and many depositions, including those of the children that were left behind by the fire and death, the case was resolved at mediation for a significant confidential amount.
Our law firm represented a fifty-one-year-old female who was struck on the interstate by an individual who was within the course and scope of his employment and driving a company vehicle. Our client was admitted to the hospital and she was diagnosed with fractured bones in her left hip and leg, two fractured ribs on her left side and hematomas in her pelvic area. In addition, she sustained back injuries and knee injuries. As a result of the accident, our client underwent several surgeries including an operation to repair her hip, surgery to fix the fracture on her leg, a total knee replacement and a total hip replacement. Since our client was working for her employer at the time of the accident and the client had received workers’ compensation benefits, the firm was able to significantly reduce the amount of money our client had to repay the workers’ compensation carrier and her medical providers, thereby resulting in an even greater financial recovery for our client.
Our firm was able to obtain a verdict in Henderson County Circuit Court for $1,019,652.13 for one individual and a verdict of $24,445.95 for another individual who were passengers in a two car auto accident in Henderson County, Tennessee. The first individual had medical bills that a medical expert related to the accident in the amount of $370,000.00. The second individual had medical bills of approximately $20,000.00, but he had serious credibility issues which the defense addressed, including a felony conviction and drug addiction issues. Prior to the trial, defense had offered the policy limit of $25,000.00 for the first individual and $7,500.00 for the second individual. Also, prior to trial, we were able to settle with the other driver involved by receiving the policy limits of $25,000.00 for the first individual and $2,500.00 for the second individual.
The law firm represented a forty-eight-year-old woman who was the chief financial officer of the company where she worked. She was involved in a catastrophic car wreck while taking a friend’s son home from school. She was severely and permanently injured, including brain trauma, a fractured left hip, a fractured left shoulder and damage to her left eye. The firm represented a widow on behalf of her deceased husband in a medical malpractice case. The Decedent went in for stomach pain. The medical personnel knew he had an abdominal aneurysm but failed to treat or consider the aneurysm as a cause of his stomach pain. The Decedent was discharged and was dead within 24 hours due to a ruptured aneurysm. The case was contested. The firm prepared the case for trial, engaged in extensive discovery, retained experts, obtained an economist to calculate loss of earning capacity and took the depositions of numerous medical personnel. The case was otherwise prepared for trial when the case was meditated and resolved for a significant amount, which is confidential.
NST represented a fifty-two-year-old woman who suffered severe injuries when she lost control of her car and struck a tree after coming into contact with loose gravel on the roadway. Another large personal injury firm in Memphis had initially investigated the wreck on behalf of the client and determined that it could not obtain a successful recovery. Liability was questionable, but NST consulted with an expert in an attempt to develop the case. Through its investigation, NST learned that a paving company had left the loose gravel on the road and failed to place a warning sign in the direction our client was traveling. The client sustained severe injuries, including an eye injury and a fractured hip. She incurred tens of thousands of dollars in total medical charges as a result of the treatment she received from the sustained injuries. Suit was filed and discovery was taken. Despite the potential of attributing significant fault to the client in this one-car accident and therefore, risking little or no recovery, NST was able to successfully mediate the case against the paving company for $355,000.00. In addition, NST successfully reduced our client’s medical bills in an effort to obtain more compensation for her.
Our Firm represented a forty-nine-year-old man who was involved in a wreck through no fault of his own while working on the job for his employer. The client suffered a traumatic brain injury in the wreck which his employer denied. As a result of his traumatic brain injury, the client developed psychological injuries which the employer denied as well. Our firm fought for the client and the employer was ordered to provide medical treatment for all his injuries. The employer hired a doctor to try and prove that client did not have a traumatic brain injury and was exaggerating his injuries. When the employer refused to pay a fair settlement for client’s permanent injuries and inability to work, our firm took the case to trial and presented the testimony of three experts to prove that client did in fact have a traumatic brain injury and psychological injuries. The trial court disregarded the employer’s “hired gun” expert witness and ruled in favor of the client and found him permanently and totally disabled and awarded a judgment against the employer in the amount of $561,916.90. Furthermore, the trial court ordered the employer to pay for the medical treatment for his on the job injuries for the remainder of his life.
Client was involved in a car wreck on highway 72 at its intersection with 311. Defendant pulled from a stop sign into client’s path and struck her on the side. Even though liability appeared to be clear, defendants disputed liability throughout the case and trial.
Client suffered connective tissue and ligament injuries to her lower back. Client sought multiple types of medical treatment to try and recover from her injuries, and she incurred over $30,000.00 in medical bills. Client was evaluated by an orthopedic surgeon who opined that her back condition was caused by the car wreck. However, defendant adamantly denied that client suffered any type of injury to her back from the car wreck and instead blamed her condition on arthritis, being overweight, and on a previous wreck that had occurred five years before.
After our client finished treating, NST lawyers attempted to resolve the case amicably, but the defendant’s insurance company would not pay fair compensation. As a result, a lawsuit was filed and the case was prepared for trial.
During litigation, the case was mediated where the defendant only offered $25,000.00, which was not adequate to compensate our client. Just prior to trial, defendants made a “take it or else” Offer of Judgment in the amount of $30,000.00. Once again, client rejected this offer since it was not sufficient to adequately compensate her.
At trial, the defendant’s legal counsel disputed liability and tried to attack our client’s good name and reputation by alleging that she was exaggerating her injuries all in an attempt to convince the jury that client was not injured. NST lawyers vigorously defended our client’s reputation, and we countered this argument by calling witnesses who testified about our client’s good character. The jury found that the defendant’s negligence was a substantial factor in causing our client’s back injury and issued a verdict in the amount of $230,000.00. Client will ask the Court to make defendant pay all of her expenses and costs in the lawsuit due to the “take it or else” Offer of Judgment in the amount of $30,000.00 made just prior to the trial.
Our firm represented a fifty-year-old female who was traveling on the highway when she came to a controlled stop due to traffic in front of her and she was rear-ended by the defendant who was texting and simply not paying attention to traffic in front of him. As a result of the accident, our client sustained a permanent injury to her left shoulder which was diagnosed as a torn rotator cuff which required surgery. The insurance company argued that our client fell during her rehab from the first surgery and that this was an independent intervening cause which reduced the related medicals to approximately $60,000. Our firm argued that but for the car wreck and the surgery, the intervening fall would not have torn out the surgical sutures. We investigated the case, conducted depositions and were able to effectively mediate the case for $310,000. The firm was also able to secure significant reductions in the medical bills.
The law firm represented the widow on behalf of her husband, who had cirrhosis of the liver and kidney disease and died approximately one month after a serious automobile collision. His injuries included a fractured left tibia which required an initial emergency surgery and then two subsequent surgeries after his leg became severely infected. Although the cause of his death was not directly related to the automobile collision, the firm was able to successfully argue that his death was accelerated due to the injuries he sustained from the collision and obtained a settlement in the amount of $700,000. We represented an individual who was injured by an employee of a company due to inadequate safety regulations. Our client was cut by a chainsaw, sustaining deep lacerations to his right arm, as well as severing tendons, which required surgery. Our client incurred medical bills in the amount of $29,775.71. Our client was working for his employer as a billboard poster, when he fell approximately 35 feet from a billboard catwalk. The judgment was in excess of $550,000.00. The court awarded client the maximum benefits he was entitled to under the Tennessee Workers' Compensation Laws.
A middle aged gentleman with a history of obesity and breathing problems was rehabilitating at a nursing home. The patient had a tracheostomy tube, which aided his breathing. This was inserted prior to entering the nursing home.
The nursing home staff failed to properly clean or regulate the patient’s tracheostomy tube. As a result, the tracheostomy tube became blocked with his own mucous. He went into cardiac arrest and was rushed to the hospital. The patient survived the incident, but had severe brain damage. He died six (6) months later due to a variety of complications.
The firm litigated and developed the case by retaining a nursing home expert and a respiratory therapist expert. We also did some investigative research into the Defendant’s financial background and employees. Finally, we aggressively deposed former and current nursing home staff members. The firm was able to take this case to mediation and resolve the matter for a confidential amount.
Our firm represented a gentleman in both an automobile accident case and a workers' compensation claim, all resulting from the same accident. While in the scope of his employment, our client was driving his vehicle when the Defendant negligently made a left turn in front of him, thereby causing the accident. Our client sustained injuries, including two (2) broken legs, a broken tail bone, chipped teeth, and some scarring. A lawsuit was filed and after discovery was conducted, the case was mediated, and a settlement was reached in the amount of $440,000.00.
A middle aged paraplegic woman was rehabilitating her shoulder after rotator cuff surgery at a nursing home. While at the nursing home, the patient was negligently left in a bathroom by the nursing home staff for over an hour. No one checked on her or heard her as she screamed for help. In desperation, the patient tried to get out of the bathroom. She fell and ended up completely tearing the same rotator cuff which had been repaired in the surgery.
The firm litigated and developed this case by retaining a nursing expert on the standard of care in the nursing home. We also investigated the surgery and obtained the surgeon’s opinion on the cause of the complete rotator cuff tear and the patient’s possibility of recovery if this incident had not happened. Furthermore, we aggressively deposed current nursing home staff members. The firm was able to take this case to mediation and resolved the matter for a confidential amount.
The firm represented a thirty-four-year-old female who was involved in an automobile accident whereby another driver lost control of his automobile and struck our client's vehicle. Our client sustained a right ankle fracture and was not able to work for an extended period of time. In addition, she had restrictions pertaining to her ability to squat, lunge, and walk. The case resolved with the defendant's liability insurance company and with our client's uninsured motorist carrier for a total settlement of $225,000.00.
The firm represented a sixty-four-year-old male who was involved in an automobile accident with a company truck, whereby the company vehicle negligently disregarded a stop sign striking our client's automobile. Our client sustained lung contusion, fractured ribs and effusion to the left lung. Further, our client received a grade 1 spleen laceration. The case was litigated and after extensive discovery, the case was mediated with a settlement in the amount of $220,000.00.

The firm represented a forty-two-year-old male who was a passenger in a vehicle which was struck by another vehicle which had crossed the middle lane while driving on the highway. Our client sustained a ruptured C5 disc which required surgical intervention. The firm utilized the services of an orthopaedic surgeon for an impairment rating, and we also retained the services of a vocational expert to determine the vocational loss of the client. According to the vocational expert, our client was not able to return to work as a landscape laborer and as a result had a significant lost wage. The case was settled for $190,000.00.
